Terms of Access, Browsing, and Use (TOABU)

These Terms of Access, Browsing, and Use (“TOABU”) govern your use of all digital properties, services, content, and assets operated by or under the control of InDjinniUs LLC DBA JinVi (the "Company"), including but not limited to www.jinvi.us and its subdomains. By accessing or using any part of the Company ecosystem, you agree to abide by these terms.

This policy is modular: it includes universal terms that apply to all Company properties, and additional terms that apply specifically to certain subsites and services, as described below. If you do not agree with any part of these terms, do not use any Company website or service.

  1. Universal Terms

    1. Applicability

      These terms apply to all visitors, users, contractors, and account holders of any Company website or digital service, including all subdomains and future properties.

    2. Intellectual Property

      All content, assets, code, game mechanics, artwork, and branding are the exclusive property of the Company, unless otherwise noted.

      1. Contact Form Submissions

        By submitting any information, feedback, or materials through a “Contact Us” or general inquiry form on any Company website, you grant the Company a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable right to use, reproduce, display, adapt, or distribute the contents of your submission for the purpose of responding to your inquiry, improving our services, or other business uses. Do not submit confidential, proprietary, or sensitive information via public forms. Submissions may be retained for compliance and operational purposes in accordance with our Privacy Policy.

      2. User-Submitted Content

        By posting, submitting, or uploading any content (including text, artwork, avatars, feedback, gameplay, or other materials) to the Company ecosystem, whether as a Champion account on joy.jinvi.us or as a Legionnaire account on hub.jinvi.us, you grant Company a worldwide, royalty-free, non-exclusive, perpetual, irrevocable right and license to use, display, adapt, modify, reproduce, distribute, publish, or remove such content for any purpose in connection with the Company’s services, marketing, or community features.

        You represent and warrant that you have all necessary rights to submit such content and that it does not infringe on any third-party rights. The Company reserves the right to remove, modify, or decline to publish any user-submitted content at its sole discretion and without notice.

    3. Digital and Virtual Goods ("Goods")

      Company may offer digital or virtual currency, items, features, content, and services ("Goods") for allocation, enjoyment, and consumption within the Company ecosystem by "Consumer" accounts on, including but not limited to, joy.jinvi.us and hub.jinvi.us. Each Good is licensed for use by only one Consumer account. Any sharing, transfer, sublicensing, or multi-user access between Consumer accounts is strictly prohibited unless expressly authorized in writing by the Company. All Goods are licensed, not sold, and remain the exclusive property of the Company at all times. No actual ownership interest in any digital or virtual Good is conveyed or transferred to any account holder or user, notwithstanding terminology such as "purchase," "buy," or "sale."

      By acquiring or allocating Goods, whether through payment, gameplay, promotion, or other means, you are granted only a limited, personal, revocable, non-exclusive, and non-transferable license to allocate or access and enjoy those Goods within the Company's services and subject to these Terms. Once consumed and bound to an account, you may not sell, lease, rent, sublicense, gift, assign, or otherwise transfer, commercialize, or exchange your access to any consumed digital or virtual Good, whether for monetary value or otherwise, except as expressly permitted by the Company in writing.

      All Goods exist solely within the Company's systems. The Company may modify, replace, suspend, or discontinue any Good, feature, or entitlement at its sole discretion, with or without notice, and without any liability to you. Any attempt to sell, transfer, or exploit Goods outside of the Company's authorized channels is strictly prohibited and may result in account suspension, revocation of Goods, or other legal action.

    4. Prohibited Activities

      • Scrape, extract, or automate access to any Company content, accounts, or services.
      • Circumvent access controls or security.
      • Use the Company's content for dataset creation, AI/ML training, or generative models.
      • Harass, abuse, or misrepresent any individual, group, or the Company.
      • Use the Company's services for any unlawful purpose.
    5. Jurisdiction

      These terms are governed by the laws of Nevada, United States, with venue in Las Vegas.

  2. Subsite- and Service-Specific Clauses

    1. www.jinvi.us (Main Portal & Marketing)

      • All promotional materials, news, and informational resources are subject to these TOABU.
      • User submissions through forms, lead magnets, or newsletters are governed by the Privacy Policy.
      • Accessibility feedback and ecosystem-wide concerns may be sent to contact@jinvi.us.
      • Use of our Contact Us or general inquiry form on the Company ecosystem requires users to first sign in via an approved external authentication provider. This control measure is in place to help defend against spoofing, spam, and automated abuse.
    2. hub.jinvi.us (Social Engagement Hub)

      • Requires user account registration. Accounts on hub.jinvi.us are Consumer accounts.
      • All community interactions (posts, comments, uploads) must follow the Company’s Community Guidelines (published and maintained separately on hub.jinvi.us).
      • No spamming, harassment, solicitation, or unauthorized promotion is permitted.
      • Moderation decisions may result in suspension or content removal.
    3. joy.jinvi.us (Online Multiplayer Games & Downloadables)

      • Requires user account registration. Accounts on joy.jinvi.us are Consumer accounts.
      • Cheating, exploiting, use of unauthorized third-party tools, or unsportsmanlike behavior is prohibited and may result in bans.
      • Downloadable resources are for personal use only and may not be redistributed, resold, or used for commercial/AI purposes.
    4. shop.jinvi.us (Ecommerce Store)

      • Requires user account registration. The Company enables real money accounts (Payor accounts) on only shop.jinvi.us. Accounts on shop.jinvi.us are not Consumer accounts
      • All purchases are subject to posted refund, return, and shipping policies.
      • For shop support, contact support@shop.jinvi.us.
      • Purchases for unfulfilled orders; unused, unopened, new physical products received during the prior 30 days; and defective products received during the prior 30 days are fully refundable, subject to the product being returned in a condition suitable for resale (“re-merchantability”). The Company reserves the right to deny a refund if a returned item is not in re-merchantable condition.
      • Purchases for unallocated Goods are fully refundable. Once consumed and bound to a consumer account, the respective purchases are non-refundable.
    5. 3p.jinvi.us (Third-Party/Contractor Portal)

      • Requires user account registration. Accounts on 3p.jinvi.us are commercial accounts. Accounts on 3p.jinvi.us are neither Consumer accounts nor Payor accounts.
      • Access is strictly limited to authorized third parties, independent contractors, suppliers, and other commercial relationships.
      • Onboarding, billing, and account management require compliance with any separate agreement or NDA with the Company.
      • All related business communications should be directed to 3p@jinvi.us.
    6. sso.jinvi.us/login (Authentication Portal)

      • This portal enables authentication with external providers for secure access to certain Company services. Accounts on sso.jinvi.us are strictly authentication accounts, with no other interaction on sso.jinvi.us.
      • By using SSO, you agree to share authentication data as described in the Company’s Privacy Policy.
      • Use of the SSO portal is subject to the same security and acceptable use provisions as the rest of the ecosystem.
      • The Company relies on external authentication providers to vouch for login security. The Company does not store or control third-party authentication credentials.
    7. Products, Games, Content, and IP

      • All products (games, swag, digital goods, etc.) and Goods of the Company are protected IP and may not be reproduced, redistributed, or used for commercial purposes without written consent.
      • Fan content is permitted only in compliance with the Company’s posted Fan Content Policy (published and maintained separately on hub.jinvi.us).
  3. Chargebacks, Disputes, and Account Restrictions

    1. Actions Following Chargeback or Payment Dispute

      If the Company receives notice of a chargeback or payment dispute related to your account or payment method, the following actions may be taken to protect both the Company and the payment method owner:

      • Block further purchases against the disputed payment method.
      • Refuse login access for the affected external authentication provider and email combination.
      • Refuse login attempts from the same associated technical fingerprint (including, but not limited to, IP address, device, or client identity).
      • Automatically refund or revoke all non-consumed goods allocated from the charged back payment method.
    2. Cascading Restrictions to Non-Payor Accounts

      If a non-payor account (including, but not limited to, Champion or Legionnaire accounts) is found to meet either of the following conditions:

      • All goods, entitlements, or content in the non-payor account were allocated exclusively from a payment method that has been subject to a chargeback; or
      • The non-payor account is associated with two or more payment methods that have each been subject to a chargeback;

      then the Company may, at its discretion:

      • Suspend or block the non-payor account.
      • Revoke, refund, or remove all non-consumed goods from the account.
      • Restrict access based on technical fingerprint (IP address, device, or client) to prevent circumvention.

      These measures are implemented to protect both the Company and payment method owners from fraud, loss of account control, or unauthorized use.

  4. Amendments

    The Company may update these TOABU at any time. Continued use of any part of the ecosystem constitutes acceptance of the current version.
